In the latest turn of events, the 16 ousted members of the Plateau State House of Assembly from the Peoples Democratic Party (PDP) are taking their legal battle to the highest court in the land following a setback at the Court of Appeal.

Despite facing a temporary setback with the dismissal of their application for review by the Court of Appeal, these lawmakers remain resolute in their pursuit of justice. Hon Dalyop Fom, the former representative of Jos South constituency in the assembly, revealed their intention to seek recourse at the Supreme Court during a briefing with journalists.

Fom explained that their legal team had exhausted various avenues, including appeals to the National Judicial Council (NJC) and correspondence with the President of the Court of Appeal, in efforts to seek a review. However, their case encountered an unexpected hurdle when it was scheduled for review before a three-man panel instead of the requested five-man panel.

Asserting the importance of procedural fairness, Fom highlighted their disagreement with the composition of the panel, insisting on adherence to legal requirements. Despite pressure from the three-man panel to proceed, the lawmakers’ counsel stood firm, maintaining that a five-man panel was necessary for due process.

Contrary to media reports, Fom clarified that their application for review had not been considered or dismissed on its merits. Additionally, the Court imposed a significant fine on each lawmaker, totaling N128 million, further fueling their determination to seek justice through the Supreme Court.

Emphasizing the gravity of the situation, Fom reiterated that an existing order prevents the Speaker of the state House of Assembly from swearing in the rival All Progressives Congress (APC) lawmakers until the case is resolved.

Initially hopeful for a possible reversal of their ousting in light of a subsequent Supreme Court ruling, the lawmakers remain undeterred in their quest for legal vindication as they turn to the Supreme Court for further adjudication.
