Falana slams FG over creation of “illegal” academic unions to checkmate ASUU

Femi Falana, an activist-lawyer, explains why the Nigerian Association of Medical and Dental Academics (NAMDA) and Congress of Nigerian University Academics (CONUA), two newly formed academic unions, are unlawful.

In an interview with the Arise TV program “Newsday” on Wednesday, October 5, Falana provided a legal viewpoint on the dispute between the Academic Staff Union of Universities (ASUU) and the Federal Government.

The well-known attorney also examined the results of floating the new academic unions.

“Under the current Labour Law regime in Nigeria, you cannot have two unions or three unions in the same sector.

“In other words, within the academia in Nigeria, there can only be one registered trade union, that is, ASUU, registered pursuant to the Trade Union Act, as amended.

“We are going to have a mushrooming of trade unions, which threatens industrial peace in the country. We cannot have two unions in the university; neither can we have two unions in other unions in the country. Politically, it won’t work,” he said.

Falana also described the registration of the new unions as illegal and a desperate measure by the government to break the strike.

He said: “Government has tried various measures, but the latest one is perhaps going to embarrass the government because it is an illegal exercise and won’t work. ASUU is today one of the most organised and united trade unions in Africa.”

The lawyer urged the government to return to the negotiation table and ensure that proper advice is sought to avoid exposing the country to ridicule.

Meanwhile, Prof. Attahiru Jega, a former Chairman, Independent National Electoral Commission (INEC), on Tuesday, October 4, 2022 said that no nation developed without adequate and appropriate investment in education sector.

Jega stated this in his keynote address at the 4th National Summit on Diminishing Corruption in the Public Sector.

The event had the theme: ‘Corruption and the Education Sector’ on Tuesday in Abuja.

The event was organised by the Independent Corrupt Practices and Other Related Offences Commission (ICPC). It was hosted in collaboration with the Office of the Federation (OSGF) and Joint Admissions and Matriculation Board (JAMB).

He said the Nigerian education sector had suffered neglect, underfunded which led to a crisis; compounded by the impact of corruption both from within the education sector itself and from the wider public sector.

A United Nigeria – The Sultanate

Arise O’Compatriots –
Arise O’Heirs of Kings and Queens,
Arise Superiors as once was before Your colonial masters –
Before the doctrines of divide and rule clusters,
Way afore trading Your kins offshore for personal aggrandisement –

Don’t You yearn for a place where Your offsprings abide heavenly?
Thereby loving Your neighbors as You loved Yourselfs –
Shall You not learn from the prime ways of Your ancestors respectfully,
A clean bill of health and wealth passed down through generations
Cherished and upheld by all nations held godly –

My eyes are teary,
My heart’s weary,
I shalt worry –
My Peoples unity has been dismantled
How did We go from the giants of Africa to the puny grabby mice
Leaching away every glee of hope from the leaders of morrow –

Bring back our nation –
That nation that floats above the surface of love,
Where peace showers down like the rain in August,
Embracing and respecting the discrepancies in our culture
Saying yes We’re different but yes We’re the same;
A bond We share like that of the Atlantic and the Pacific,
Pillars firmly built on trust for one another –
A nation where every single vote counts and voices of the voiceless heard,
A hearthstone where nations envy for it’s unsurmountable mineral resources –

Bring back our nation of fine trade and fertile agriculture
Where We go to the farm in peace and back in one piece,
Where our security is priority –
Give us a nation that understands the power of the pen
Where our education is affordable and our classroom condusive,
A state that doesn’t strip me of my rights to literacy –

Give me back the Nigeria I knew,
Give me a Nigeria I never knew,
Give us “A united Nigeria”.

NANS accuses President Buhari of burying education

President Muhammadu Buhari is being charged by the National Association of Nigerian Students (NANS), South-West Zone, with burying public education in the nation. The association has stated that it is prepared to arrange a funeral for public education.

The students said on Monday that they will be returning to the streets in the coming days in a statement that was jointly signed by their coordinator and spokesman, Adegboye Olatunji and Awoyinfa Opeoluwa, respectively.

“It behooves us to call the attention of the general public and the international community on the brazen insult meted on the mass of Nigerian students by the irresponsible administration of Buhari.

“Without considering the fact that Nigerian university students have been at home for close to eight months as a result of the failure of this administration to meet the demands of striking lecturers and to properly fund education, the Minister of Education, Mallam Adamu Adamu, is to be conferred with the National Honour of Commander of the Order of Niger.

“The recognition of patronage on the Minister has not just demystified the sacredness of National Honours, it has further shown to the mass of Nigerian students that this administration does not regard the youths as being critical stakeholders as far as national development is concerned.

“To say that a man under whose watch university students have been at home for close to eight months due to the strike embarked upon by lecturers, got recognised by the President, and to be conferred with a National Honour, is a direct attack on the mass of students,” the NANS statement partly read.

NANS also called on Buhari to take over negotiation with the striking Academic Staff Union of Universities, and no longer leave it in the hands of the Minister of Labour and Employment, Chris Ngige.

Reacting further, NANS said, “rather than concentrating on the task of governance, the President is distributing National Honours to different characters, mostly misfits. How can you be honouring people who have made the cost of living so high, and reduced the standard of living?”

“We condemn and reject the National Honours and some of its recipients. We want Nigeria students to be ready for grand mass action on the ASUU strike. We are clear that this government is anti-public education and this is against the yearnings of millions of students and youths.”

Buhari vows to provide funds needed to end ongoing ASUU strike

President Muhammadu Buhari has again called on striking Academic Staff Union of Universities (ASUU) to return to the classroom while assuring them to deal with their contending issues within the limits of the scarce resources available.

The president, who reiterated the call in a nationwide broadcast on Saturday, October 1, in Abuja, said he was pained by the recurring disruption to nation’s tertiary education system.

The broadcast was part of activities to mark the nation’s 62nd Independence Day Anniversary.

According to him, the Federal Government will continue to mobilise resources, both internationally and nationally, towards funding education to ensure that citizens are well educated and skilled in various vocations.

”I must confess that I am very pained by the recurring disruption to our tertiary education system.

”I am using this Independence Day celebration to re-iterate my call for the striking Academic Staff Union of Universities (ASUU) to return to the classroom while assuring them to deal with their contending issues within the limits of the scarce resources available.

”This administration has made appreciable progress in redressing these issues that have been lingering for over eleven years.”

According to Buhari, this is in view of the fact that education is a leading determinant of economic growth and employment generation.

”As we put in place all measures to ensure that Nigeria takes her place in the Comity of Nations, we recognise the importance of a well-educated populace as a panacea to most of the challenges we face.

”We have, therefore, pursued policies and implemented programmes designed to create a literate and proficient society that ensures that citizens are availed with opportunities for life-long achievements.”

On health sector, the Nigerian leader revealed that his administration had also improved the nation’s health facilities, especially during and after the outbreak of the COVID-19 pandemic.

He said this had attracted commendation of the global community.

”As you are aware, Nigeria was one of the countries that defied global predictions of the socio-economic impacts of the COVID-19 pandemic because of our resilience, commitment and passion with which we individually and collectively managed the pandemic.”
