U.S. court releases certified true copies of Bola Tinubu’s drug dealing, money laundering case in Chicago

The United States District Court for the Northern District of Illinois has released fresh documents holding Bola Tinubu’s encounter with American authorities over allegations of narcotics trafficking and money laundering.

Mr Tinubu, the presidential candidate of the ruling All Progressives Congress and former Lagos governor, has come under intense public ridicule and political onslaught for his role in an early 1990s drug trafficking case in Chicago.

Mr Tinubu has not commented on the narcotics affair, which has made headlines since at least the mid-aughts, preferring instead to discuss other parts of his background in corporate accounting, consultancy and pro-democracy activism. He, however, informed the electoral office INEC in his application to stand for the election that he had no prior criminal convictions.

Mr Tinubu’s allies have also made efforts to downplay the matter entirely as a trivial distraction to Nigeria’s democratic experience because it happened decades ago in a distant lang.

But Nigerians have insisted that the presidential candidate should come clean on his involvement in the case, which saw him forfeit up to $460,000 to the U.S. authorities in 1993.

The 56-page document released by the district court’s headquarters in Chicago did not include crucial new details, but it further confirmed snippets of the matter that had been shared spontaneously by the media for years. Journalist David Hundeyin also reignited interest in Mr Tinubu’s drug-dealing background following a July 13 article in West Africa Weekly.

The latest certified copies of the court case, obtained on August 10, showed Mr Tinubu and two others named K.O. Tinubu and Alhaji Mogati were involved in banking proceeds of illicit drugs and money laundering with Heritage Bank and Citibank. It was not immediately clear whether or not ‘Alhaji Mogati’ was a misspelling of Alhaja Abibatu Mogaji, Mr Tinubu’s foster mother, who passed on in 2013.

The U.S. government had in July 1993 sought forfeiture of proceeds of narcotics Mr Tinubu was accused of laundering. The matter was resolved in a compromise between the Tinubus and the U.S. authorities, with the Tinubus being asked to keep the money in the Heritage Bank account while the $460,000 in the Citibank account was forfeited.

A federal judge subsequently dismissed the matter with prejudice on September 21, 1993, which effectively foreclosed the matter from being litigated again by all parties. It, however, remained unclear whether or not Nigerian authorities could still bring charges against Mr Tinubu over the same case in Nigerian courts.

Kalu Kalu Agu, an Abuja-based lawyer with ties to opposition politics, has been among those seeking to hold Mr Tinubu to account over the matter. He petitioned the EFCC and NDLEA, Nigerian anti-graft and anti-narcotics departments, respectively, to probe Mr Tinubu’s involvement in the drug charges before the presidential elections in February.

In the November 8 petition, Mr Kalu Agu gave both offices seven days to launch action against Mr Tinubu or be compelled through a judicial order of mandamus, a process that involves ordering a public department to perform a public duty.

“It is our view that you have a historic duty to ensure that Senator Bola Ahmed Tinubu is called to account for his deeds in money laundering arising from his involvement in narcotics trafficking,” Mr Kalu Agu said from his think-tank Centre for Reform & Public Accountability in Abuja.

Mr Tinubu, who has been on a campaign tour through the country, did not return a request seeking comments about the released court documents and Mr Kalu Agu’s petition to federal authorities. A spokesman for his campaign also declined comments.

Court Convicts EFCC Boss Of Contempt, Sends Him To Kuje Prison

A High Court of the Federal Capital Territory (FCT) in Maitama has convicted the Chairman of the Economic and Financial Crimes Commission (EFCC) Abdulrasheed Bawa for contempt of court in relation to his agency’s failure to comply with an earlier order

Justice Chizoba Oji, in a ruling, held that

“The Chairman Economic and Financial Crimes Commission is in contempt of the orders of this honourable court made on November 21st 2018 directing the Economic and Financial Crimes Commission, Abuja to return to the applicant his Range Rover (Super charge) and the sum of N40, 000,000.00 (Forty Million Naira).

“Having continued willfully in disobedience to the order of this court, he should be committed to prison at Kuje Correctional Centre for his disobedience, and continued disobedience of the said order of court made on November 21st, 2018, until he purges himself of the contempt.

“The Inspector General of Police shall ensure that the order of this honourable court is executed forthwith,”

The judge said.

Justice Orji rejected the arguments put forward by the lawyer to the EFCC, Francis Jirbo, to justify his client’s action.

The ruling delivered on October 28, a certified true copy (CTC) of which The Nation sighted in Abuja on Tuesday, was on a motion on notice marked: FCT/HC/M/52/2021 filed by Air Vice Marshal (AVM) Rufus Adeniyi Ojuawo, a one-time Director of Operations at the Nigerian Air Force (NAF).

Ojuawo had, in the motion filed by his lawyer, R.N. Ojabo, in a suit marked: FCT/HC/CR/184/2016 complained that the EFCC declined to comply with the order, for the release of his seized property, made by the court in a judgment delivered on November 21, 2018

NDLEA warns public about new deadly drug, Fentanyl

The National Drug Law Enforcement Agency (NDLEA) has learned of individuals’ plans to bring Fentanyl, an illegal substance, onto the Nigerian market.

This was announced by the Director of Media and Advocacy, Femi Babafemi, in a statement on Tuesday, November 8, 2022.

The NDLEA stated that Fentanyl was 100 times stronger than Tramadol and issued a warning that the illegally produced drug could result in a large number of fatalities among the youth population that the cartels are targeting.

The drug now accounts for more than 70% of overdose deaths. Also, it is a significant factor in both fatal and nonfatal overdoses in the US. The NDLEA warned that it must not be permitted to circulate in Nigeria due to its lethality and current drug misuse.

NDLEA said, “We are not unaware of desperate efforts by some drug cartels to introduce to the Nigerian market, Fentanyl; which according to the CDC, is 80 times as potent as morphine and 100 times more potent than heroin.

“This, they plan to do either in liquid or powder form and/or with misleading labels to target our youth population.

“This they may also mix with other prescription drugs. The illegally manufactured fentanyl in its liquid form can come in nasal sprays, eye drops, or small candies.

“As a result, parents and other stakeholders are advised to be vigilant; alert, and warn their young ones against attempting to experiment with this illicit substance. Symptoms for fentanyl exposure and/or overdose include pinpoint pupils, falling asleep or losing consciousness, slow and shallow breathing; choking or gurgling sounds, limp body, and pale, blue, or cold skin.”

The agency assured the public that all necessary assets had been deployed to monitor the cartels involved; with a view to frustrating their criminal plot and making them face the wrath of the law.

No More Postponement of Elections for Logistic Reasons – INEC Chairman

The Independent National Electoral Commission (INEC) is determined to ensure that elections are never again postponed at the eleventh hour on account of election logistics, through its proactiveness and effective collaboration with relevant stakeholders.

The Commission’s Chairman, Prof. Mahmood Yakubu, gave the assurance at the inauguration of the Electoral Logistics Committee (ELoC), held at the INEC Headquarters, Abuja on Friday 4th November.

According to him, the establishment of the inter-agency committee was borne out of the Commission’s effort to ensure the speedy and safe delivery of huge quantities of sensitive and non-sensitive materials for the 2023 General Election.

Other members of the Committee include; staff of the Commission, heads of the Nigerian Immigration Service, the Federal Road Safety Service Corps (FRSC), the Federal Fire Service, and various Aviation agencies. Others are the President of the Nigeria Union of Road Transport Workers (NURTW), and heads of other transport unions in the country.

The Committee, which is chaired by National Commissioner, Major General Modibo Alkali (Rtd), has the following Terms of Reference (ToR) to; develop a seamless strategic plan for the airlift, receipt, and distribution of sensitive materials; determine areas of challenges or inadequacies in material storage, vehicles, aircraft, cargo, and other material delivery modes in order to ensure timeous delivery of materials for the election; and determine, source, and coordinate air cargo carriage and delivery to specified airport in Nigeria.

The Committee was also mandated to: determine, source and coordinate truck cargo carriage and delivery to specified States, Local Government Areas etc; develop and define a workable template for the provision of security, transportation and deployment/distribution of materials for election; identify and map out difficult terrains, areas with security challenges and crises prone areas; identify the mode of transportation to those areas.

ASUU fumes as FG reveals reason for payment of half-salaries in Oct.

The Federal Government has provided an explanation for why it did not pay lecturers employed by the Academic Staff Union of Universities (ASUU) their full salary.

The Federal Ministry of Labour and Employment issued a statement, on Saturday, November 5, noting that ASUU members had received a pro-rata payment of their October salaries.

According to the statement, pro-rata was used since it is impossible to pay for work that has not been completed.

The statement went on to say that Chris Ngige, the honourable minister of labour and employment, never gave the Accountant General of the Federation instructions to pay university professors half wage.

The statement reads in part, “Following the ruling of the Court of Appeal, which upheld the order of the National Industrial Court of Nigeria, asking ASUU to go back to work, the leadership of the union wrote to the Minister, informing him that they have suspended the strike. The Federal Ministry of Education wrote to him in a similar vein and our labour inspectors in various states also confirmed that they have resumed work.

“So, the Minister wrote to the Federal Ministry of Finance, Budget and Planning, directing that their salaries should be restored. They were paid in pro-rata for the number of days that they worked in October, counting from the day that they suspended their industrial action. Pro-rata was done because you cannot pay them for work not done. Everybody’s hands are tied.”

Meanwhile, US President Joe Biden would exert appropriate pressure on President Muhammadu Buhari to ensure free and fair elections in 2023, according to former Goodluck Jonathan adviser Reno Omokri.

Reno Omokri made this claim in an interview with Channels TV’s Politics Today, on Thursday, November 3, 2022.

“Atiku Abubakar’s visit was an invitation by the United States government to have a briefing with him. He met with the US Assistant Secretary of State. The meeting was hosted by the State Department. But there were several other people from different branches of the executive arm of the United States treasury, departments of justice, defence, etc.

“They talked about their plans and how they will liaise with Nigeria. And they want to hear from him, like how he intends to handle Nigeria’s US relationship. One of the things he talked about. He talked about the election and how to deliver free and fair elections.

“In the past, they (the US) waited until after the election before they intervened. But this time around, they are going to be watching for comments and actions that may lead to violence so that they would take action. So, what is the action they are going to be taking? There is going to be fair pressure directly from President Biden on President Muhammadu Buhari to ensure the elections are free and fair,” Omokri said.

INEC restrict RECs from visiting government houses, meeting politicians

Ahead of the 2023 general elections, the Independent National Electoral Commission (INEC), on Thursday, prohibited Resident Electoral Commissioners (RECs) from paying visits to government houses and meeting politicians in their States of assignments.

INEC Chairman, Mahmood Yakubu, who gave the order in his remarks at the swearing-in ceremony of 19 RECs in Abuja, yesterday, charged the electoral officials to be responsible.

Mahmood also reiterated his commitment to ensure free and fair elections in the 2023 polls, pledging that the commission will not disappoint Nigerians.

According to him, the electorate via their votes would determine winners for the elections, reiterating that its loyalty and allegiance would be to the country and its citizens.

While directing the RECs on their responsibility ahead of the election, Mahmood urged them to abide by the law and regulations of the commission.

Directing the RECs, Yakubu said: “As you are deployed to various states of the federation, you will be responsible for human and material resources. Work with the staff and be guided by the provisions of the law and our various regulations and guidelines.

“You should not be visitors to Government Houses and must never hold unofficial meetings with politicians, even after official working hours.

“All matters pertaining to official responsibilities should be conducted in the office attended by the relevant staff and the issues must be properly documented.”

It is exactly 113 days from now, Nigerians would decide their new leaders at both the State and the federal level.

Hushpuppi sentenced to 11-year jail term for fraud in US

Hushpuppi, a popular Instagram user from Nigeria, Ramon Abbas, was found guilty of fraud and received an 11-year prison term.

In its most recent session, the United State Central District Court in California handed down the sentence.

However, because Hushpuppi has already served two years in imprisonment since his arrest in 2020, he will serve a total of nine years in prison.

A joint team from the Dubai Police and the Federal Bureau of Investigation of the United States detained the social media influencer in Dubai in June 2020 for allegedly defrauding a number of victims, including Americans.

After being extradited, Hushpuppi was accused of numerous offenses including hacking, impersonation, scamming, banking fraud, and identity theft.

In July 2021, Hushpuppi entered a plea agreement with U.S. authorities and admitted guilt to allegations of multimillion-dollar fraud.

Hushpuppi and his attorney Louis Shapiro persuaded U.S. federal judge Otis D. Wright to postpone his sentence in September 2022; following several appeals, bringing the most recent hearing to November 3.

Since Hushpuppi’s conviction in 2021, the date of his sentence had been postponed four times.

Valentine’s sentencing was initially scheduled for February 14 before being moved to July 11; then September 21 before being carried out on November 3, 2022.
