Lalong Legacy Project: Bleneson Reaffirm that its contract with Lalong is still valid and cannot be re-awarded

Engr Lawson Ngoa, Managing Director, Bleneson Services Nigeria Ltd, confirm that their PROJECT REMAINS VALID AND CANNOT BE RE-AWARDED: BLENESON SERVICES NIG LTD (CONTRACTOR FOR LALONG LEGACY PROJECT)

He stated clearly that:

  1. The State Government said the facts alleged by me are misleading, which of those facts are misleading? Is it that it’s executive council did not sit in order to attempt to re-award the said contract? Or that there is no pending litigation on the subject matter (the off shoot of which even the subcontractors have instituted a suit because they have been instigated to think that the company has been paid, when the government that has refused to pay the company)? or is it that the governor has never confirmed by himself by stating that ‘70%-80% of the job has been completed’? or is it that with the actions of the govt there won’t be more litigation? Or can the State Government show any genuine prove that it has paid money on the project to an account, either personal or the company’s for this project?

2. The State Government is being minimal with the truth by withholding valuable information and giving misleading fabrications to the people of the State. The appointment of an independent valuer is not part of the agreement entered into by parties. Even the several valuations carried out by the Project Monitoring Committee (PMC) jointly instituted by the parties were not honoured by the state government. How could I have known that the State Government wanted to or had appointed an independent valuer when I was not informed about their intention to do so? Did the State Government embark on this valuation through its purported independent valuers so it can pay the company its outstanding? Well, if that was the intent of the State Government for unilaterally appointing the valuers, they did not send invitation to the company for any reconciliation of accounts and neither have they paid me or the company anything, regardless of it said completed valuation.

3. It is obvious that the State Government wants to disregard the rule of law on a subject matter that is before the court, we call on the Federal Government, the Judiciary and every well-meaning Nigerian to see how the Plateau State Government is muddling up and destroying the livelihood of the contractor and subcontractors, who are now heavily indebted as a result of the government’s refusal to offset it’s accrued debts on this project for the past one year. This only empathically shows that the State Government terminated the contract using state might.

4. As to the allegation that we moved out of the state and all that was purported by the government, we have facts to contravene this distortion, because our offices in the State are still in existence and our staff are always around, particularly the office in the State Capital Jos, so how could we have been said to move out. Of course, as a result of the looting from us during and after the covid-19, and to prevent our machinery from wear and tear that would have occasioned as a result of the hostility of the government towards our staff by refusing them access to the sites, we had to remove valuable equipment to safe locations, with the anticipation that we will resume work as soon as issues are resolved or the court grants our reliefs.

5. The people of Plateau State should know that due to the State Government’s refusal to pay us, we had sought all means of amicable resolution, but to our dismay the State Government dragged us to the Tax Appeal Tribunal before this termination letter that was sent to us. I was in Jos for several days reaching out to have a roundtable discussion with the Governor and relevant stakeholders to the project so issues can be ironed out amicably, and yet the Government said I kept mute and didn’t approach them!
Seeing the body language, and because of the urgency of the situation as this had become an emergency, we immediately followed suit by doing all that is required by law and filed a case to that effect before the State High Court to restrain them amongst other things before the expiration of the 30days notice. This are facts verifiable in the public domain. So, how can our going to the court to seek redress be an afterthought? There was no such thing as consent by conduct on our part as we didn’t sleep on our rights, so this is not a situation of laches and acquiescence.

6. I will not dabble into that as a matter of respect to the court, we have strong faith in the judiciary, and we believe that justice shall be done. However, the issue of damages that the State Government is hammering on, in the case of this Lalong Legacy Project damages has not yet arisen. The issue of damages can only come up if and when the contract has been rightly terminated. This is what we are contending, that the termination is invalid, as we have not bridged any terms of the contract, neither have we refused to continue with the project nor has any of our act or omission brought the lifespan of the contract to an end, simple.
Seeking redress is a post contract issue which does not apply in the instant case. May be if the courts adjudge the contract as terminated, then we can talk of a redress for damages.
I urge the subcontractors to resist all attempts to be instigated further by the State machinery against the contractor. They should be the reassured of the contractor’s commitment in defending the Project as they ensure that nothing happens to the respective work the contractor allocated to them.

Presidency responds to alleged removal of INEC Chairman, non-usage of BVAS

The presidency has reassured Nigerians that President Muhammadu Buhari has no plans to oust Mahmood Yakubu as INEC chairman over the adoption of the bimodal voter registration system (BVAS) in the general elections of 2023.

Femi Adesina, the presidency special media and publicity adviser, denied that INEC will be prohibited from utilising BVAS in the upcoming general elections.

Adesina noted that Buhari had stressed the need for technology in conducting a good election while speaking in Abuja on Tuesday, November 1.

Buhari will support the use of BVAS in the upcoming general election, according to the presidency.

He said: “Recently, there was one group that said the Chairman of INEC was going to be removed because maybe they didn’t want BVAS.

“How many times has the President spoken about the role of technology in getting him into office?

“Then he said until technology came and there were permanent voter cards and so it was difficult to write results.

“So, how and why can the same person have issues with BVAS? I saw that group on television, alleging that there was a plan to remove the INEC Chairman and the media gave them that opportunity.”

Adesina cautioned journalists against allowing people with sinister motives to disrupt the 2023 general elections by spreading false rumours.

Meanwhile, the Minister of Agriculture and Rural Development, Dr Mohammed Abubakar, has dismissed concerns that Nigerians will experience food shortages in the coming months due to the ravaging floods across the country.

Abubakar said this while responding to questions from lawmakers on Monday, October 31, at the budget defence session of the ministry before the National Assembly.

The budget defence was jointly organised by the Senate and House of Representatives Committees on Agriculture.

Some of the lawmakers in their separate submissions had decried the effects of floods in the country, especially on farming.

They also said that projections had been made that Africa might experience food shortage given the stoppage of grain importations occasioned by the Russia-Ukraine war.

But Mohammed said, “The main concern about food scarcity, in the coming months, we will not allow that to happen, I can guarantee you by the Grace of God because we have measures in place.

“One of the measures is dry season farming, which we have in place and the money, we are working with the Ministry of Finance, we have gotten money from financing agencies, one of them is AFDB, and we will intensify dry season farming.”

Elon Musk announces $8 monthly charge for verified Twitter accounts

Elon Musk indicated on Tuesday that a verified account on Twitter in the future could cost $8 a month, despite facing a user backlash over proposals to charge for the feature.

In a Tuesday tweet to his more than 110 million followers, the new owner of Twitter described the current system for allocating blue check marks – which verify a user as a trustworthy source – as “bullshit”.

“Twitter’s current lords & peasants system for who has or doesn’t have a blue checkmark is bullshit. Power to the people! Blue for $8/month,” he wrote; suggesting that a tick could be given to accounts that subscribe to the platform’s premium service, Blue.

Musk further stated that costs might vary according to country. Several nations, including the US, Canada, Australia, and New Zealand, offer Twitter’s Blue service. In its current form, the service offers a more limited range of benefits, such as the ability to undo tweets. It costs $4.99 per month in the US.

Musk claimed in the Twitter discussion that Blue subscribers would also receive preference in responses, mentions, and searches. This, he said, is “important to combat” spam accounts. Users will also be able to submit lengthy video and audio clips and view half as many advertisements. No timing for the changes was announced.

On Monday, information about Musk’s plans to charge for verification leaked, which infuriated several users, including Stephen King. King, who had tweeted that if a $20 tick charge were implemented “I’m gone like Enron.”

A Twitter poll floating the idea had an 80% response for the option “wouldn’t pay”. However, one of Elon Musk’s investors in the acquisition of Twitter backed the $8 plan. The founder and chief executive of Binance, said he supported the plan since it would deal with annoying bots. Binance has invested $500 million in the agreement.

Fire guts bank building under construction in Lagos

Fire has destroyed a bank building under construction on Adeola Odeku Street in the Victoria Island of Lagos State, injuring nine people.

The Lagos State Emergency Management Agency (LASEMA) said the nine persons, all male adults, suffered burns and injuries; and were taken to an undisclosed hospital.

“Investigation gathered at the scene revealed the fire emanated from the generator house,” LASEMA said.

A car, outside the building, belonging to Rapid Response Squad (RRS) was also burnt.

First responders including officials of LASEMA, Lagos Fire Service and Rescue, amongst others prevented the inferno from spreading.

The Agency said it received distressed calls of the outbreak at about 10.03am on Tuesday, and rescue operation commenced immediately.

The agency’s spokesperson, Amodu Shakiru who confirmed the incident said the details about the fire outbreak will be communicated later. The agency also said the dampening down process of the incident scene is still in progress.

Cases of fire outbreaks are common in Nigeria’s commercial capital. On April 13, a similar incident occurred in the Maryland area of Lagos that made people to panic. Just last week, the head office of the West African Examination Council was ablaze. A few weeks ago, a popular plaza in Idumota also was in flames.

The state’s emergency response team have taken time to sensitize the populace on the importance of safety at home and work spaces.
